2. SUBJECT

The subject of this Preliminary Information Form is to inform the Buyer in accordance with the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts published in the Official Gazette dated March 6, 2011, and numbered 27866, regarding the sale and delivery of the goods and/or services whose qualities and sale prices are specified below.

4. PRICE INCLUDING ALL TAXES

5. DELIVERY TIME / METHOD

Delivery will be made as soon as possible after payment is confirmed and stock is available. Delays may occur due to force majeure (e.g., natural disasters, adverse weather conditions). The seller is obligated to deliver the goods/services within 30 (thirty) days from the order date.

Delivery will be made to the address requested by the Buyer. If the Buyer requests delivery to a different person or address, delivery will be made in accordance with that request. Delivery costs are borne by the Buyer unless the Seller has announced on the website that such costs will be covered for purchases above a certain amount.

Delivery is handled by courier companies. The Distance Sales Contract must be signed and delivered to the Seller, and payment must be completed through the selected method. If payment is not made or is canceled in the banking records, the Seller is not obligated to deliver the goods/services.

The consumer must inspect the goods before accepting delivery and should not accept defective or damaged goods from the courier. By accepting the delivery, the Buyer acknowledges that the product was received in good condition.

 

6. PAYMENT METHOD

Payment can be made via credit card, bank transfer (EFT), or wire transfer.

 

7. RIGHT OF WITHDRAWAL

The Buyer may withdraw from the contract without any legal or penal liability and without providing any reason, within 14 days of delivery for goods and from the date of contract for services. If the service is to be provided before the end of the 14-day period, the right of withdrawal may be exercised until the service starts. The cost of withdrawal is borne by the Seller.

To exercise the right of withdrawal, the Buyer must notify the Seller via fax, telephone, or email within 14 days. The goods/services must be returned in original condition and packaging without damage and in a resalable condition. Procedures for return under the right of withdrawal are detailed in the Distance Sales Agreement.

The original invoice for the returned goods/services must also be sent back. Refunds are made within 10 days of the notice of withdrawal, and goods/services are collected within 20 days. If the original invoice is not returned, VAT and any other legal charges cannot be refunded.

If the value of the goods/services is diminished due to the Buyer's fault or the goods/services become impossible to return, the Buyer is responsible for compensating the Seller.

 

9. NON-RETURNABLE GOODS/SERVICES

The right of withdrawal cannot be exercised for the following:

·         Perishable goods/services or those with expired shelf life,

·         Single-use items,

·         All types of software and programs that can be copied,

·         Opened CDs, DVDs, VCDs, MDs, video cassettes,

·         Stationery consumables (e.g., toner, cartridges, ribbons),

·         Cosmetic products that have been opened or used.

 

10. VALIDITY

This Preliminary Information Form is read and approved by the Buyer electronically before the Distance Sales Agreement is concluded.

 

11. COMPETENT COURT

For complaints and disputes, the Buyer may contact the Seller via the contact details listed in Article 1.

Consumers may apply to Consumer Arbitration Committees for disputes:

·         Under 2,000 TL to district committees,

·         Between 2,000 TL and 3,000 TL to provincial committees (3,000 TL in metropolitan municipalities),

·         Above these amounts, applications must be made to Consumer Courts.

 

12. FINAL PROVISIONS

If any documents or information related to the order are found to be missing, false, or misleading, or if there is suspicion that the order is made in bad faith or for commercial gain, the Seller reserves the right to suspend or cancel the order. The Buyer will be notified in such cases. Any payment refund processes will be communicated to the Buyer.

This information is provided in accordance with Article 5(3) of the relevant regulation, in good faith and in consideration of the protection of minors, individuals lacking discernment, or those under legal guardianship.

The Buyer hereby acknowledges, declares, and undertakes that they have read and understood the preliminary information in compliance with Article 48 of the Law No. 6502, and that they have given their confirmation electronically.
